President Alvi has been caught in the cross-fire of a one-sided bureaucracy and a political coup.
The Constitution of Pakistan awards Arif Alvi, our sitting President(Of Pakistan), certain powers that may be exercised at his own discretion. The delays on passing of laws, the removal of civil servants, and pardoning any individual, and supersede any order passed by any court(s) or tribunal.
The constant fight of safeguarding the presidency from the immature political standstill, has been a major feat and probably a first time for righteousness within the halls of power in Pakistan. President Alvi first denies of agreeing to Bills passed by Parliament. Then, when realizing his own Secretary may be at fault, called for his instant removal from his post.
Many political enemies and anti-Alvi parties have sought to disregard and insult the President, by naming him as the problem within the state-machinery.
As follows, are the solutions that Alvi may choose, constitutionally, and/or otherwise:
1 – The President can Pardon Imran Khan and have him out of prison within a moments notice.
2 – The President may remove any civil servant, in writing.
3 – The President may ask for reconsideration of a bill, and then be allowed to determine its outcome within a total of 25 Days.
4 – The President may pass an executive order and dissolve Parliament and appoint a new Caretaker setup as the Constitution allows.
The trivial problem here is not what the President did, or how he has executed powers in his position. It is the unfortunate reality of the lack of readership of the Constitution, the understanding of the laws, and its overall application to the system. If any individual in his position is questioned, can also be considered someone who is not loyal to the State, for the President is your Commander-in-Chief, and will have power over you, regardless of his position being of only an observer rather than an involved Public Servant.
The ripple-effect of Alvi’s actions, have led the Chief Justice of Pakistan to declare that the Toshakhana case conducted by the lower-courts was done so improperly, and now they wait for the High Court to take a decision so that it will be rendered correct. As soon as a positive move has been taken by the Judiciary, Raja Pervez, the incompetent Speaker of the House, decided to take a hit at the selection of judges within the country. The absolute irony, of how undeserving politicians, decide to take jabs at judges they favoured when the court orders were favourable, but decided to joust as soon as the wind changed.
That is the conundrum of the situation as a whole right now. The President of Pakistan has taken a very positive stance in assuring that no law is passed in favor of personal gain and motive. No law of man should be disturbed for personal grudges and hate. The law was built to defend the individuals and their virtues, not to carry-out feuds.
Whether you support Imran Khan or not is not in question. No institute should be made a mockery, and no one should have the right to create bias legislation that are set for momentarily gain. These institutes should concentrate on defending everyone, whether he be your enemy, or whether he be your friend.
President Alvi, the hero Pakistan truly does not deserve.
